These Terms and Conditions ("Terms") govern your access to and use of the myPoll.ai-driven survey platform (the "Platform") operated by myPoll.ai ("we," "us," "our"). By accessing or using the Platform, you ("User," "Participant," or "you") agree to be bound by these Terms. If you do not agree, please do not use the Platform.

At myPoll.ai, your privacy is our priority. All survey responses are collected, processed, and stored in an anonymous and aggregated form. This means no individual participant can be identified from the data.
 
Results may be shared with trusted third parties, such as academic collaborators, research institutions, or funding agencies, but only in anonymous form and solely for educational or scientific purposes. Your personal information will never be sold, licensed, or commercially exploited.

1. Purpose of the Platform

The Platform is designed to facilitate rigorous, public-facing research through the collection of accurate survey data. Its primary purpose is to advance scientific understanding and contribute to research and scholarship. myPoll.ai does not sell, license, or otherwise commercially exploit your personal data. Our aim is to collect high-quality data while also sharing valuable insights with Platform participants.

2. Eligibility

By using the Platform, you represent and warrant that:

You are at least 18 years of age (or the age of majority in your jurisdiction); and

Your use of the Platform is voluntary and subject to applicable laws and institutional review protocols.

3. Informed Consent

Before participating, you will be provided with information about the research, including its objectives, procedures, potential risks, and benefits. By completing surveys or otherwise engaging with the Platform, you acknowledge that you have been informed of your rights and consent to participation.

4. Data Collection and Use

Data Collected: The Platform may collect survey responses, demographic information, and metadata (e.g., time of completion, device type).

Anonymity and Aggregation: All data will be collected, processed, and stored in a manner that ensures it is anonymous and aggregated. Personally identifiable information (PII) will not be collected, disclosed or shared unless explicitly requested and additionally consented to by you.

Sharing with Third Parties: Anonymized and aggregated data may be shared with pre-authorized third parties, including but not limited to academic collaborators, research institutions, and funding agencies, for legitimate scientific and educational purposes. Individual participants will never be identifiable in such shared data.

Data Retention: Data will be securely stored and retained only as long as necessary to fulfill the research objectives and comply with applicable laws and ethical standards.

5. Confidentiality

We are committed to protecting your confidentiality. Data will always be de-identified and aggregated before analysis or sharing. We employ reasonable technical, administrative, and organizational measures to safeguard data against unauthorized access, disclosure, alteration, or destruction.

6. No Commercial Use of Data

Your participation does not result in the sale, licensing, or monetization of your personal information by myPoll.ai. Any data shared is anonymous and aggregated, used strictly for academic and research-related purposes.

7. Voluntary Participation and Right to Withdraw

Participation is entirely voluntary. You may refuse to participate or withdraw at any time without penalty. If you withdraw, any data already collected may be retained in anonymized and aggregated form for research integrity purposes.

8. Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, algorithms, interfaces, design, and content (excluding your survey responses), remain the property of myPoll.ai or its licensors. You are granted a limited, non-transferable, non-exclusive license to use the Platform solely for participation in research activities.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be error-free, secure, uninterrupted, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, myPoll.ai and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses arising from or related to your use of the Platform or participation in surveys.

11. Compliance With Laws and Ethical Standards

The Platform operates in accordance with applicable data protection laws, institutional review board (IRB) or ethics committee approvals, and research integrity guidelines.

12. Third-Party Services

The Platform may integrate third-party tools or services solely to facilitate survey delivery and analysis. Such third parties are contractually bound to handle only anonymized and aggregated data, and to use it exclusively as instructed by myPoll.ai.

13. Changes to the Terms

We reserve the right to update, modify, or replace these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and Ireland, without regard to conflict of law principles.
